Your Rights Under the Australian Consumer Law

Under the Australian Consumer Law (ACL), Schedule 2 of the Competition and Consumer Act 2010, consumers are entitled to automatic guarantees when they purchase goods or services. These guarantees cannot be excluded, restricted, or modified by contract.

When you purchase goods from us, we guarantee that the products will:

Products are fit for the purpose for which they are commonly supplied, or any specific purpose you told us about.

Products match the description, sample, or demonstration model we provided at the time of sale.

Clear Title
We have the right to sell the goods, and you will receive full ownership free from any undisclosed encumbrances.

Reasonable Durability
Products last for a reasonable period of time given their nature and price.

Spare Parts & Repairs
Where applicable, spare parts and repair facilities are reasonably available for a reasonable period after purchase.

Your Remedies

If a product fails to meet a consumer guarantee, your remedy depends on whether the failure is major or minor:

  • Major failure β€” You are entitled to a full refund, replacement, or compensation for the drop in value. You may also claim compensation for any reasonably foreseeable loss.
  • Minor failure β€” We will repair the product within a reasonable time at no cost. If we cannot repair it, you may choose a replacement or refund.
πŸ“‹ A failure is major if: the product is unsafe; substantially unfit for its common purpose; significantly different from its description; or you would not have bought it had you known about the problem.

How to Make a Claim

To make a claim under the Australian Consumer Law, please contact us within a reasonable time of discovering the issue:

Email us at support@thedesibazaar.com with your order number, a description of the problem, and photos where applicable. We will respond within 2 business days and work with you to resolve the issue promptly.

🚚 If a product needs to be returned due to a major failure or defect, we will cover the cost of return shipping.

Limitations

Consumer guarantees do not apply if:

  • You were aware of the fault before purchasing and bought the product anyway
  • You caused the fault through misuse, accident, or abnormal use
  • You used the product in a way that the manufacturer did not intend
  • The goods were altered or modified after purchase without our knowledge
